Terms & Conditions for consumers

Contest Details, Concept and Participation:

1. These terms and conditions are applicable to the contest "Buy Parle Marie and win a trip to Thailand" (hereinafter referred to as "Contest") for the consumers based and resides under the territory of Maharashtra only. This Contest is sponsored and launched by Parle Biscuits Pvt. Ltd. (hereinafter referred to as ‘Parle’) wherein consumers can participate by calling up and register themselves on the Consumer Care Cell number 022-66916929 only when they find the lucky coupon inside the biscuits packets of Rs.5/-, Rs.10/- & Rs.30/- of Parle Marie Biscuits.

2. The contest is valid only in the State of Maharashtra, starting from 01/08/2019 at 12:01 midnight to 30/09/2019and ending at 05:00 PM(herein after referred as "Contest Period")

3. During the Contest Period, participant(s) shall stand a chance to win a‘4-day/3-night trip for two to Thailand’ hereinafter referred to ‘Prize’.

4. The Contest is subject to all applicable state and local laws and regulations of Maharashtra.

5. Consumers participating or seeking to participate in the Contest shall individually be referred to as "Participant" and collectively as "Participants".

6. The lucky coupon shall be valid only till 05.00 PM of 30th September 2019, irrespective of the shelf-life of the product pack. The Registration lines will be closed at 05.01 PM from 30th September, 2019 onwards as mentioned hereinabove. No one can participate in the contests from there onwards.

Agreement to Terms and Conditions:

1. By participating in this contest, Participants fully and unconditionally agree to and accept these Terms and Conditions available on www.parleproducts.com/pmoffer ("hereafter referred to as Contest Website"). The decisions of Parle shall be final and binding in all matters related to the Contest. Successfully entering the Contest and standing a chance to win a 4-day/3-night trip for two to Thailand is subject to all requirements set forth herein.

2. Parle shall reserve the right to exclude any person from the contest on grounds of misconduct or criminal record or for any other reasons, as it may deem fit and proper. No communication in this regards shall be entertained.

Eligibility:

1. This Contest will be open for all adults above 18 years of age of the state of Maharashtra only.

2. The Contest will be open to all customers’ residents of Maharashtra except the employees of Parle, their family members, and people including their family members having business relationship with the company etc.

3. Parle or its Agency will not be responsible for any NDNC (National Do Not Call) Registry regulation that will come into play. All Participants who participate will agree as per the terms and conditions that even if they are registered under NDNC, DND (Do Not Disturb), Parle or its Agency shall have all the authority to call such shortlisted winners by virtue of them having voluntarily participated in the Contest.

Contest Period & Contest Timings:

1. The contest will be commencing from 12.01 midnight of 01/08/2019 and ending at 5:00PM of 30/09/2019 (hereafter referred to as the “Contest Period");

2. Entries coming outside the Contest Period will not be considered for winner selection;

3. The trip starts from assembling all the shortlisted Winners at Mumbai airport and ends after landing at Mumbai airport (hereafter referred to as the “Trip Period");

4. In order to register for the contest on finding the coupon in the packs of Parle Marie, customer needs to call on 022-66916929 between 10am-5pm between Monday-Friday only during the contest period;

5. The contest shall run on the Rs.5/- (45gm), Rs.10/- (90gm) & Rs.30/- (250gm) SKUs of Parle Marie Biscuits in the state of Maharashtra.

Prize (4-day/3-night trip to Thailand):

1. During the Contest Period, Participants will be chosen and they will be eligible to win a trip for 2 people to Thailand for 4-days and 3-nights. Whosoever above the age of 18-years is able to find the lucky coupon in the SKUs of Parle Marie Biscuits of Rs.5/-, Rs.10/- & Rs.30/-needs to call up on 022-66916929 between 10am-5pm from Monday – Friday only during the contest period to confirm and register. The winner can take only one *co-traveler with him/her.

*Co-traveler profile:

1. The co-traveler is a person who will travel along with the winner.

2. The co-traveler can be a minor, however, needs to be accompanied by an adult.

3. If the co-traveler is an opposite gender, the relationship with the shortlisted winner has to be proved via government certified documents.

4. The co-traveler is bound by all the Terms & Conditions of this contest.

How to Participate:

1. On finding the coupon in the packs of Marie Biscuits of Rs.5/-, Rs.10/- & Rs.30/-, customer needs to call up on 022-66916929 between 10am-5pm (Monday-Friday) only during the contest period to confirm and register.

Parle and the Partner Agency shall not be responsible for (including but not limited to):

1. Any SPAM generated messages.

2. The Operator Code not being displayed on the user's mobile phones;

3. Any SMS message delivery failures;

4. Any lost, late or misdirected computer transmission or network, electronic failures or any kind of any failure to receive entries owing to transmission failures or due to any technical reason.

5. If the participant has registered himself to the DND of the telecom provider/ the participant has registered with National Do Not Call Registry/ Participant has specifically requested for not receiving messages for the specific campaign.

6. Other conditions beyond its reasonable control.

Winner Selection:

1. After finding the lucky coupon in the packs of Parle Marie Biscuits of Rs.5/-, Rs.10/- & Rs.30/- packs, the customer needs to call up on the number (022-66916929) between 10am-5pm (Monday-Friday) and register.

2. Trip to Thailand for 4-days/3-nights will be given subject to the winner satisfying the verification process of Parle.

3. The Prize cannot be transferred, exchanged or redeemed for cash. In the event that the winner does not take the prize in the time and manner stipulated, then the prize will be forfeited by Parle and no cash will be awarded in lieu of the contest prize. Prizes must be taken as offered and cannot be varied.

4. Any unused prize is not-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken in exchange for cash.

Contacting Winners:

1. Once the Winners are selected, Parle shall provide prizes to the winners after the verification procedures are completed.

2. In the event the shortlisted winner's number is busy, unreachable, or he/she does not attend the call, two (2) more attempts will be made to reach the Participant on that day and/or the next day. If even on the third attempt, the Participant does not attend the call, or is unreachable, the Participant's participation in the contest comes to an end and the Participant's entry stands canceled and Participant becomes ineligible to receive the prize.

3. In the event the shortlisted winner attends the call on either the second or third attempt, the procedure outlined in below Step 5 shall apply.

4. If any shortlisted winner remains unreachable on the third attempt or is not interested in continuing in the Contest or is otherwise ineligible to participate, the prize is forfeited.

5. In case of a positive response from the shortlisted winner, a representative from Parle shall review the following set of documents:

   1. The coupon found in the pack and its authenticity.

   2. Copy of Address Proof

   3. Copy of Mobile Number Proof

   4. Copy of PAN Card is Mandatory.

   5. Copy of Indian Passport with 12 months Validity for the shortlisted winner and the co-traveler.

   6. Documents to verify the relationship of the winner with the co-traveler.

   7. If all the documents reviewed by Parle representative are correct and within the stipulated timelines, the winner shall be treated as a Confirmed Winner

   8. In case the passports (of the shortlisted winner and the co-traveler) are not ready, the same has to be provided to us within the deadline as mentioned below:

      • Last date for entertaining winner calls: 30th September, 2019 (until 5:00PM only)

      • Last date for verification: 5thOctober, 2019

      • Last date for submitting all documents: 7thOctober, 2019

6. No prize will be awarded if the information presented by the Participant(s) at the time of entering the contest is not factually correct.

7. In the event of death of the Confirmed Winner, no claim from the nominee or his/her legal heirs of the Confirmed Winner shall be entertained for receiving the prize. In such event the co-traveler will also not permitted to travel.

Publicity:

1. The Participant/s undertake and irrevocably and unconditionally permit Parle to cover the Contest through various media including newspapers, radio, television, news channels, internet, point of sale materials, etc., and shall not raise any objection, protest or demur to such coverage or in this regard.

2. The winners must, at the request of Parle, participate in all promotional activity (such as publicity and photography) surrounding the winning of the prize, free of charge, and they consent to Parle using their name and image in promotional material.

Intellectual Property:

1. All right, title and interest, including but not limited to the Intellectual Property Rights, in the promotional material(s) and in any and all responses received shall vest solely and exclusively with Parle at all times. Parle or any person or entity permitted by Parle in this regard shall be entitled to use the responses received or any information in connection with the entry in any media for future promotional, marketing, publicity and any other purpose, without any permission and or payment to the Participant.

2. All material submitted in connection with the Contest (whether written, audio, electronic or visual form, or a combination of those) or any photographs, video and/or film footage and/or audio recording taken of Participants are assigned to Parle upon submission and become the property of Parle exclusively. Parle may use the material in any medium in any reasonable manner it sees fit. Copyright in any such material remains the sole property of Parle.

General Conditions:

1. Each Participant represents and warrants that he/she is legally competent to enter into binding contracts under applicable laws. By taking part and/or entering into the Contest the Participant warrants that all information provided by Participant regarding Participant's name, age, state, city, address, phone number, etc., is true, correct, accurate and complete.

2. The decision of Parle or its Agency, as regards the selection of winners and distribution of the prizes shall be final, subject only to Parle’s approval. No correspondence or any other claims whatsoever, in this regard will be entertained.

3. No queries, claims, dispute, complaints or grievances shall be entertained by Parle after 5 business days from the date of the closure of the contest period.

4. Nothing contained herein amounts to a commitment or representation by Parle to conduct further Contests.

5. The decision of Parle shall be final in all regards and no communication shall be entertained in this regard. None of the provisions of these Terms and Conditions shall be deemed to constitute a partnership or agency between any Participant and Parle and the Participant shall not have the authority to bind Parle in any manner whatsoever.

6. Parle or any of its respective officers/employees/directors shall not be responsible for delayed, lost, mutilated, corrupted or illegible documents etc.

7. Parle or its Agency shall not be liable to perform any of its/their respective obligations under the Contest or in respect of the prize where it is unable to do so as a result of circumstances beyond its/their control in the nature of fire, explosions, natural calamities, state emergency, riots, or any other Force Majeure condition, etc., and shall not be liable to compensate the Participant in these circumstances.

8. Parle or its agency shall not be accountable/liable for any disruptions/stoppages/interruptions or cancellation of the Contest due to any government restrictions.

9. Failure to exercise or delay in exercising a right or remedy provided hereunder or by law does not constitute a waiver of the right or remedy or waiver of other rights or remedies on the part of Parle or its Agency.

10. Parle or its agency accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, loss of SMS, loss of internet connectivity, unique codes, documents, demand drafts, claims or correspondence whether due to error, omission, alteration, tampering, unauthorized data hacking, deletion, theft, destruction, virus attack, transmission interruption, communications failure, hardware failure or otherwise. Parle or it’s agency shall not be liable for any consequences of user error including (without limitation) costs incurred.

11. If a Participant is dissatisfied with the Contest or the Contest rules and/or any content or any requirements of the Contest form, the materials available related thereto, or with these terms and conditions, his/her sole and exclusive remedy is to not participate in the Contest.

12. If a person chooses to access the Contest Website from outside India, he/she shall do so on his/her own initiative and shall be responsible for compliance with applicable local laws of the country.

13. The participation in the Contest is purely voluntary and same shall be construed as an acceptance of the terms and conditions stipulated herein.

14. Prize cannot be treated as a cash equivalent under any circumstances or interpretation and the vendor shall under no circumstance exchange the voucher for cash.

15. Validity of Prize cannot be extended.

16. Agency shall provide the prize on an "as-is basis" and without any warranty or guarantee concerning the quality, suitability or comfort. Parle and/or its associates, affiliates and/ or its management, directors, officers, agents, representatives shall not be responsible for or liable (including but not limited to the product and service liabilities) for deficiency and/ or defect of any product/service and/or Prize or for any kind of consequential damages/ loss, in any manner whatsoever.

17. This offer is available to qualifying Parle customers only.

18. Only Indian Nationals holding valid PAN cards issued under the provisions of the Income-Tax Act, 1961 shall be entitled to participate under this Promotion.

19. All additional taxes if any will have to be borne by the customers.

20. Any additional costs to be incurred due to natural calamities, political disturbance, accidents or any unforeseen circumstances shall not be borne by Parle.

21. To participate in this contest Regular call and message/data usage rates apply.

22. To use this offer, Standard fair usage policy and usage norms set by the respective telecom operator apply

23. The offer is non-transferable, non-assignable and cannot be sold, or redeemed for cash. There is no cash alternative to this offer and all reservations are strictly subject to promotional availability.

24. All disputes arising out of or in connection to this scheme are subject to exclusive jurisdiction of the courts in Mumbai only.

25. Winners travelling to the destination shall be merged with another group.

26. Visa-on-Arrival in Thailand shall be applicable as part of this tour.

27. As per the rule and regulations of Thailand government, a traveller must carry sufficient funding (at least 10,000 Baht or 325 US Dollar per person), failing which immigration clearance and entry in Thailand is not possible.

Release and Limitations of Liability:

1. Parle shall under no circumstances be liable, whether jointly or severally, for any loss or damage suffered or sustained (including but not limited to consequential loss), including for personal injury or property damage suffered or sustained, as a result of acceptance of any prize.

2. By entering the Contest, the Participant hereby releases from and agrees to indemnify Parle, and/ or any of its respective officers/employees from and against all liability, cost, loss or expense arising out of acceptance of the prize or participation in the Contest including (but not limited to) personal injury and damage to property and whether direct, indirect, consequential, foreseeable, due to some negligent act or omission, or otherwise.

3. Parle and the agency accept no liability, whether jointly or severally, for any errors or omissions, whether on behalf of itself, Agency or third parties in relation to the Prize.

4. The Participant shall be solely responsible for any consequences which may arise due to his/her participation in the Contest by conducting an illegal act. Participant also undertakes to indemnify Parle and/or the Agency and their respective officers, directors, employees and agents on the happening of such an event (including without limitation cost of attorney, legal charges etc.) on full indemnity basis for any loss/damage suffered by Parle or the Agency on account of such act on the part of the Participant.

5. In consideration of Parle allowing the Participant/s to take part in the Contest, to the maximum extent permitted by law, the Participant/s waive and release each and every right or claim, all actions, causes of actions (present or future) each of them has or may have against Parle, its respective agents, directors, officers, business associates, group companies, sponsors, employees, or representatives for all and any injuries, accidents, or mishaps (whether known or unknown) or (whether anticipated or unanticipated) arising out of the Contest or related to the Contest or the prize of the Contest.

Dispute:

1. The courts of competent jurisdiction at Mumbai shall have exclusive jurisdiction to determine any and all disputes arising out of, or in connection with, the Contest. Participation in the Contest is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including (without limitation) this clause.

2. Further all issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the Participants and/or Parle and/or Partners of this Contest, shall be governed and construed in accordance with the laws of the Republic of India.

Terms and Conditions for 3-Nights / 4-Days Trip to Thailand for 20 people:

1. The offer entitles the holder for a holiday package to Thailand for 3 Nights and 4 Days. Return Air fare are economy class and subject to availability;

2. The package includes return economy class airfare, 3N/ 4D stay at a hotel inclusive of meals, airport transfer & sightseeing on shared basis.

3. The package flights will have fixed departure and return from ex Mumbai. In the event, if the winner is from outside Mumbai but within Maharashtra, then the winner will have to travel to-and-fro Mumbai at their own expenses including travel & hotel charges if applicable.

4. Parle’s responsibility ends with handing over the prize ticket to the winner.

5. This offer does not include any additional costs (e.g. extra nights, food & beverage or other charges) that, if incurred, must be paid for directly to the hotels. Only Indian Nationals holding valid PAN cards issued under the provisions of the Income-Tax Act, 1961 shall be entitled to participate under this Promotion.

6. Once confirmed travel dates, hotel dates, hotel type or venue cannot be changed under any circumstances on request of the winner. Parle and its agency reserve the right to alter the same

7. Parle will not be responsible for approval or application for VISA, Passports and any other documents which the passengers may require to travel into a foreign country.

8. All services including the Airline Seat Availability, hotel & room category are subject to availability at the time of booking.

9. Once Parle receives all passenger names, name changes will not be accepted.

10. Any additional costs to be incurred due to natural calamities, political disturbance, accidents or any unforeseen circumstances shall be borne by the winner/traveler and in no circumstances will be paid by Parle or its agency.

11. Hotel check in and checkout time as per hotel policy.

12. The offer is non-transferable, non-assignable and cannot be sold, or redeemed for cash. There is no cash alternative to this offer and all reservations are strictly subject to promotional availability.

13. Parle is not responsible for the management of the hotels, airlines and will accept neither liability nor claims for disappointment or dispute in relation to the management of the hotels as the operations of the same shall be outsourced to the travel partner.

14. The travel partner will issue a tentative itinerary, hotel names, visa, ticket etc along with their separate terms and conditions which have to be strictly adhered by the winners and co-travelers

15. The traveler agrees to abide by the terms and conditions as set by Parle’s travel partner. Parle and its agency reserve the right to alter/cancel the winner if terms and conditions issued by the travel partner are violated.

16. Any dispute arising from this promotion is subject to jurisdiction by the courts of Mumbai.
